Personal Injury Protection (PIP) refers to no-fault benefits contained
in an automobile insurance policy that are paid any time you are in an
accident. In the State of Kansas, unless specifically disclaimed, personal
injury protection coverage is required on all automobile policies with
a minimum limit of $4,500.00 for medical expenses, $900 per month for
wage loss, and $25 per day for substitution benefits. PIP policies pay
for your medical bills, wage loss and essential services, regardless of
who was at fault in causing your accident.
In the event that someone else was at fault in causing your injuries, you
may recover the value of those expenses paid by PIP from the negligent
third party, known as a tortfeasor. If you recover compensation from a
tortfeasor, you may have a legal obligation to reimburse the PIP carrier
in certain situations. Being able to identify when PIP liens are valid
and the extent to which PIP carriers are entitled to reimbursement can
be critical to obtaining a satisfactory net recovery.
